Role, appointment, and removal from office of the deputy mayor
(1) The deputy mayor is subordinate to the mayor and, in situations provided by law,
acts as their legal substitute, exercising the mayor's duties on their behalf. The mayor can delegate a portion of their responsibilities to the deputy mayor.
(2) The deputy mayor is elected, by secret ballot, with an absolute majority, from among the members of the local council, upon the proposal of the mayor or local councilors.
(3) The vote is conducted using ballots. The election of the deputy mayor is done through a decision of the local council.
(4) In the case of electing two deputy mayors, the candidates who have obtained an absolute majority of votes are declared elected. In this situation, the local council designates, by decision, which of the two deputy mayors exercises the role of the mayor's legal substitute.
(5) The removal from office of the deputy mayor can be done by the local council, through a decision adopted by secret ballot, with a two-thirds majority of the number of councilors in office, upon the well-founded proposal of the mayor or one-third of the number of councilors in office. The removal from office of the deputy mayor cannot be done in the last 6 months of the local council's term.
(6) The local councilor who is running for the position of deputy mayor, as well as the incumbent deputy mayor whose change is proposed, participate and vote in the deliberation and adoption of decisions regarding the election or removal from office of the deputy mayor.
(7) During their term of office, the deputy mayor retains their status as a local councilor, without receiving the corresponding remuneration, and is subject to the incompatibilities specific to the position of deputy mayor provided in Book I, Title IV of Law No. 161/2003, with subsequent modifications and completions.
(8) The term of office of the deputy mayor is equal to the term of the local council. In the event that the local council's term ends or the status of local councilor ceases before the normal duration of 4 years, the deputy mayor's mandate ceases automatically, without any other formality.
