ART. 129
The duties of the local council
(1) The local council has initiative and decides, according to the law, on all matters of local interest, with the exception of those given by law to other local or central authorities.
(2) The local council exercises the following categories of duties:
a) duties regarding the administrative-territorial unit, its own organization, as well as the organization and functioning of the mayor's specialized apparatus, local public interest institutions, and autonomous local companies and directorates;
b) duties regarding the economic-social and environmental development of the commune, town or city;
c) duties regarding the administration of the public and private domain of the commune, town or city;
d) duties regarding the management of local interest services;
e) duties regarding interinstitutional cooperation at internal and external levels.
(3) In exercising the duties provided in paragraph (2) letter a), the local council:
a) approves the status of the commune, town or city, as well as the regulations on the organization and functioning of the local council; an indicative model of the status of the administrative-territorial unit and an indicative model of the regulations on the organization and functioning of the local council are approved by order of the minister in charge;
b) elects the deputy mayor(s) from among the local councilors, at the proposal of the mayor or the local councilors, under the conditions of Art. 152 paragraph (2);
c) approves, according to the law, at the proposal of the mayor, the establishment, organization and staffing of the mayor's specialized apparatus, public institutions of local interest, the restructuring and staffing of the autonomous local directorates, as well as the establishment, restructuring or dissolution of local interest companies and their staffing;
d) exercises, on behalf of the administrative-territorial unit, all rights and obligations corresponding to the shares held in companies or autonomous directorates, under the conditions of the law;
e) decides on the establishment or restructuring of institutions, public services, companies and autonomous directorates, under the conditions of the law.
(4) In exercising the duties provided in paragraph (2) letter b), the local council:
a) approves, at the proposal of the mayor, the budget of the administrative-territorial unit, the appropriations, the use of the budget reserve and the closing account of the budget execution;
b) approves, at the proposal of the mayor, the contracting and/or guaranteeing of loans, as well as the contracting of local public debt through the issuance of securities, on behalf of the administrative-territorial unit, under the conditions of the law;
c) establishes and approves local taxes and fees, under the conditions of the law;
d) approves, at the proposal of the mayor, the technical and economic documentation for local investment works, under the conditions of the law;
e) approves strategies for economic, social and environmental development of the administrative-territorial unit;
f) ensures a favorable environment for the establishment and/or development of businesses, including through the valorization of existing assets, as well as through the realization of new investments that contribute to the fulfillment of regional and local economic development programs;
g) ensures the execution of works and takes the necessary measures to implement and comply with the provisions of the commitments undertaken by Romania as a member state of the European Union in the field of environmental protection and water management for the services provided to citizens.
(5) If the budget of the administrative-territorial unit, provided for in paragraph (4) letter a), cannot be adopted after two consecutive meetings, which take place within a maximum period of 7 days, the activity shall be carried out based on the budget of the previous year until the adoption of the new budget, but no later than 45 days from the date of publication of the state budget law in the Official Gazette of Romania, Part I.
(6) In exercising the duties provided in paragraph (2) letter c), the local council:
a) decides on the administration, leasing, rental or free use of public property of the commune, town or city, as applicable, as well as of the local public services, under the conditions of the law;
b) decides on the sale, administration, leasing, free use or rental of private property of the commune, town or city, as applicable, under the conditions of the law;
c) approves or authorizes, according to the law, territorial planning and urban development documentation for localities;
d) assigns or changes, under the conditions of the law, the names of streets, squares and any other objects of local public interest.
(7) In exercising the duties provided in paragraph (2) letter d), the local council ensures, according to its competence and under the conditions of the law, the necessary framework for providing local public services of local interest regarding:
a) education;
b) social services for the protection of children, persons with disabilities, elderly persons, families and other individuals or groups in need;
c) health;
d) culture;
e) youth;
f) sports;
g) public order;
h) emergency situations;
i) environmental protection and restoration;
j) conservation, restoration and enhancement of historical and architectural monuments, parks, public gardens and nature reserves;
k) urban development;
l) personal records;
m) bridges and public roads;
n) local community services of public utilities;
o) emergency services such as mountain rescue, lifeguard and first aid;
p) social-community administration activities;
q) social housing and other residential units owned by the administrative-territorial unit or under its administration;
r) the enhancement, in the interest of the local community, of the natural resources within the administrative-territorial unit;
s) other local public services established by law.
(8) In exercising the duties provided in paragraph (2) letter d), the local council:
a) supports, under the conditions of the law, the activities of religious denominations;
b) approves the construction of social housing, the criteria for the allocation of social housing and the utilities of the residential units owned or administered by it.
(9) In exercising the duties provided in paragraph (2) letter e), the local council:
a) decides, under the conditions of the law, on cooperation or association with Romanian or foreign legal entities for the financing and joint implementation of actions, works, services or projects of local public interest;
b) decides, under the conditions of the law, on twinning the commune, town or city with administrative-territorial units from other countries;
c) decides, under the conditions of the law, on cooperation or association with other administrative-territorial units in the country or abroad, as well as on joining national and international associations of local public administration authorities, for the promotion of common interests.
(10) In exercising the duties provided in paragraph (2) letters a), b) and d), the local council:
a) may, in whole or in part, with the agreement of the holder of the property right or the right of administration, provide the works and funds necessary for the rehabilitation, equipping and operation of the buildings in which authorities or public institutions whose activities are of local interest are conducted. Goods purchased for equipment remain the property of the administrative-territorial unit;
b) may, in whole or in part, with the agreement of the institution or public authority holding the property right or the right of administration, carry out works for the arrangement, equipping and maintenance of buildings or land owned by the public or private property of the state, in order to increase the level of tourist attractiveness of the administrative-territorial unit, provided that, through the expressed agreement, the owner allows public access to the improved areas for a period of at least 5 years. Goods purchased for equipment remain the property of the administrative-territorial unit.
(11) For the fulfillment of the duties provided in paragraph (2), the local council may request information and reports from the mayor, deputy mayor and the heads of public service providers and public utility providers of local interest.
(12) The local council decides on the granting of bonuses and other benefits, according to the law
